Privacy policy

Last update: May 2018

ARTICLE 1 – AGREEMENT
The Client has the right to cancel the agreement up to 48 hours prior to the start of the wedding coverage. Any reservation fee already paid will be retained as a cancellation fee.

ARTICLE 2 – QUOTATIONS AND OFFERS
A composed quotation does not oblige the Photographer to carry out part of the assignment for a corresponding proportion of the quoted price. Offers or quotations do not automatically apply to future assignments. If the Photographer incurs costs for the use of a location on behalf of the Client, all such costs shall be borne by the Client.

ARTICLE 3 – PAYMENT
The reservation fee must be paid upon booking. This confirms the service and secures all stated rates. The reservation fee is non-refundable, as the Photographer reserves the date exclusively for the Client and declines other inquiries upon receipt of the payment. By paying the reservation fee, the Client agrees to these Terms & Conditions.

The remaining balance must be paid within two weeks after the wedding and prior to delivery of the photos, unless otherwise agreed.

ARTICLE 4 – PRIVACY
The Photographer respects the Client’s privacy and will treat all personal information confidentially. Data will not be sold to third parties and will only be shared with parties involved in fulfilling the assignment (for example, album production). The Client agrees to respect the Photographer’s personal data in the same manner.

ARTICLE 5 – DAMAGES
Neither the Photographer nor the Client shall intentionally use the images created during the agreed session in a way that may harm the other party. The Photographer will always strive to deliver a final product that meets the Client’s expectations.

ARTICLE 6 – OWNERSHIP
The Client acknowledges that no ownership or copyright of the created images is transferred, in any form.

ARTICLE 7 – USE OF IMAGES BY THE CLIENT
Commercial use by the Client (including but not limited to sales, commercial publications, merchandise, or business use) is only permitted with prior explicit written consent from the Photographer.

Personal use is permitted. Crediting the Photographer (including name and website: www.forlovewelive.com, instagram.com/forlovewelive) when publishing images (online or offline) is appreciated.

ARTICLE 8 – USE OF IMAGES BY THE PHOTOGRAPHER
The Photographer reserves the right to use the created images for promotional purposes, including online and offline portfolio, website, social media, and advertising. The Photographer will handle all images respectfully, in accordance with Article 5 of these terms.

ARTICLE 9 – DELIVERY OF PHOTOS
The Photographer will select and deliver a curated set of edited images from all photos taken. Editing includes cropping, color correction, and contrast adjustments in the Photographer’s signature style. The edited images will be delivered within two months via a secure private online gallery. RAW (unedited) files will not be delivered.

Delivery times are indicative; in case of force majeure, the Photographer will inform the Client in a timely manner.

ARTICLE 10 – ILLNESS / FORCE MAJEURE
In the event of illness or force majeure, the Photographer will inform the Client as soon as possible. If one of the photographers is unable to attend, a replacement will be arranged to complete the assignment. If both photographers are unavailable, a substitute photographer will be arranged and the reservation fee will be refunded.

FOR LOVE WE LIVE has a network of approximately 300 professional photographers to find suitable replacements.

ARTICLE 11 – BREACH
If it is determined that either party fails to comply with these terms, the Photographer will notify the relevant party in writing. If no resolution is reached, further steps may be taken in accordance with the terms of the Dutch Photographers Federation and/or Dutch law.
